Service and Accommodation
McSoli Tours Inc. has made every effort to ensure that the information and the photographs contained on its site are accurate. However, should a change in the itinerary occur, inclusions may be varied with or without prior notice.

All prices on this site are based on standard rooms at the hotels. We reserve the right to substitute hotels of similar category without notice. Cruises may change their itinerary due to low or high water levels in the Nile.

All hotel rooms/cabins are contracted to third parties. Any special requests will be subject to hotel/cruise availability.

Please note that due to religious festivals or national holidays and/or unforeseen reasons, a rerouting of your program may occur occasionally. Clients unhappy about any service should inform our local representative in the destination, or the hotel/cruise manager, since it will be difficult to take effective action upon your return.

For any unused services, tours, hotel nights, or airlines, no refund will be provided.

The description of facilities provided at hotels and all information herein are provided in good faith, and every effort has been made to ensure their accuracy. However, it is possible that hoteliers, shopkeepers, nightclub owners, and other third parties (over whom we have no control) may wish to change their facilities (e.g. a swimming pool may be closed for maintenance or emptied for cleaning, or a discotheque may be closed for redecoration) which may then be temporarily or permanently unavailable. In some cases, the operation of air-conditioning or central heating is at the discretion of the management as is the heating of swimming pools. Some hotels charge for nightclubs or discotheques, tennis courts, mini-golf, table tennis, deck chairs, umbrellas, health clubs, beach equipment and similar additional facilities. The operation of swimming pools is at the discretion of hotel management and clients who require confirmation of availability of swimming should check when booking their holidays. Hotels offering satellite TV may provide only a limited selection of channels in English.

Children

Reduced rates are applicable for children 12 and under. Proof of age must be provided to McSoli Tours at the time of booking the tour. Children’s rates are 65% of the regular adult rates. If a child is not covered under any travel insurance policy (which includes trip interruption, cancellation and medical), then waiver/s must be signed by the child’s parent or guardian.

Emergency
For immediate attention to any issues, conflicts or in case of any emergency, McSoli Tours Inc. will provide immediate assistance; therefore, we encourage you to email us immediately at sales@mcsoli.com, call our emergency line at (604) 288 7992 or call our Toll Free number at  1 800 – 260  6022 and choose option 3. (Only valid within North America).

Deposit and Payment
A non-refundable deposit of 25 % is required at the time of booking and the balance is due 60 days prior to departure.

Cancellation
Cancellation more than 60 days *before your departure date results in the forfeiture of your deposit (*day one of your cancellation will be calculated from the day before your actual date of departure). Cancellation less than 60 Days before your departure date will result in forfeiture of your tour costs. However, the Trip Interruption and Cancellation policies in most insurance policies cover the cancellation amount, please refer to Travel Insurance. Please note that we reserve the right to charge a fee of CAD $50 for a change of a confirmed booking. For all Specials and Group Tours, cancellation results in forfeiture of the deposit. Cancellation of any special program or group trips is 100 % non-refundable.

Quality Standards
Travelers should be aware that different living standards, practices and different standards and conditions with respect to the provisions of utilities, services and A1- Accommodation may exist outside North America. The quality standards of hotels and other services described in this site are established according to the standards of each particular country. If, due to circumstances beyond our control, the local supplier makes changes in itineraries, schedules, or hotels, we reserve the right to substitute any of the services or hotels with similar or better ones.

What Is Not Included?
Cost of obtaining passports, beverages, laundry, room service, excess baggage, phone calls, meals, other than those specified in the itinerary, optional sightseeing, medical expenses, tips, Travel Insurance and any other item not mentioned in the list of included features in each item of the tour cost.

Baggage Allowance
Each airline has its own regulation for baggage allowance and weight limits. Please check with your airline before departure.

Travel Insurance
All customers are obligated to arrange for Travel Insurance that includes medical and emergency coverage as well as Trip Interruption and Cancellation coverage. Travel Insurance is considered a requirement. Customers who do not arrange for Travel Insurance must inform McSoli Tours Inc. and sign a waiver prior to their departure.

Customer will have to provide their Travel Insurance policy information to McSoli Tours Inc. prior to leaving for their tour.

Travel Documents
It is the customer’s responsibility to ensure that they have the appropriate documentation to enter the country you are visiting. All passengers must have a valid passport (valid for a minimum of six months from the last date of the tour), and an entry – Visa (please ask for details). If traveling with a minor under the age of 18, additional considerations may apply. We will not assume any responsibility whatsoever for any passenger not having the correct documentation and no refunds will be made.

Our Responsibilities
Our contracts are with various third parties, such as airlines, hotels, cruise lines, etc. Each of these companies has its own Terms and Conditions for doing business, and you will be bound by them. The issuance or acceptance of such tickets shall be deemed as consent to those future conditions. McSoli Tours Inc. shall not be in any way liable for injury, damage, loss, accident, delay or any irregularity in any vehicle or through the act of default of any third party or other person, including any loss or additional expenses due to delay or changes in connection herewith. We do not accept responsibility for changes in A4 - Transportation schedules or other causes. The right is reserved to refuse any person as a member of any tour, or to change or withdraw the tour as circumstances demand. Each exchange coupon, order or ticket is to be regarded as one contracted by or on behalf of the particular third party or person named in it. We will not be held responsible for any failure to obtain valid travel documents or failure to arrive at the airport on time on the day of departure for any reason. Baggage is carried at the owner's risk. The company assumes no responsibility for damage, loss, or mishandling of baggage. Baggage insurance is included in most Travel Insurance packages.


Governing Law
The Terms and Conditions and any order, reservation, or purchase made with McSoli Tours Inc., on the Internet Site or directly with McSoli Tours Inc., shall be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.

You consent and submit to the exclusive jurisdiction of the courts located in the City of Richmond, in the Province of British Columbia, Canada, in all disputes arising out of or relating to the Terms and Conditions or any claim, of any kind whatsoever, made against McSoli Tours Inc.

The customer hereby acknowledges that the point of origin for this contract is the City of Richmond, in the Province of British Columbia, Canada.

Severability
The Terms and Conditions shall be deemed severable. In the event that any provisions of the Terms and Conditions are determined to be unenforceable or invalid, such provisions shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity or enforceability of any other remaining provisions.

Entire Agreement
These Terms and Conditions constitute the entire agreement between McSoli Tours Inc. and you regarding the subject matter of this agreement, and supersede all prior or contemporaneous communications, whether electronic, oral or written between McSoli Tours Inc. and you with respect to such subject matter.

Limitation on Liability
IN NO EVENT SHALL McSoli TOURS INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS OR OTHER REPRESENTATIVES BE LIABLE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER, TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY GOODS OR SERVICES PURCHASED DIRECTLY FROM McSoli TOURS INC. OR THROUGH McSoli TOURS' INTERNET SITE.
